Trump Upends Law, Undermines Climate and Clean Air by Rescinding California's Clean Air Authority

WASHINGTON
The Trump administration has announced its intention to withdraw California's current Clean Air Act waiver and assert that federal vehicle rules pre-empt state authority. This would remove the state's long-standing ability to set strong vehicle emissions standards that other states can adopt, as 13 states and the District of Columbia have. This unprecedented move endangers clean air protections and violates the law, according to the Union of Concerned Scientists (UCS).

"As the climate crisis escalates, more states are looking to strong vehicle standards to cut emissions. The law is clear--California can set its own emissions standards and other states can adopt those standards. This legal reality has created momentum around the country for clean car standards, with more states considering adopting California's rules. Unfortunately, President Trump is determined to weaken vehicle standards, regardless of the law or the public interest.
"The Trump administration is trying to nullify key parts of the Clean Air Act, violating states' longstanding authority to set and adopt more stringent emissions standards. This move doesn't just defy the plain language of the law; it slams the brakes on technological advancement and throws a wrench into states' ability to deal with air pollution and confront the growing risk of climate change. It's yet another way the administration is defying science, the law, and democratic norms to enable increased pollution.
"If the Trump administration gets its way, it will force drivers to needlessly burn up billions of gallons of gasoline, increasing the danger of climate change and weakening the American auto industry. Taking away state authority on emissions is a purely political move, violating law, science, and the normal regulatory process, and it's going to face a serious challenge."

U.S. Sen. Bernie Sanders and Congresswoman Jan Schakowsky on Wednesday introduced a bill that aims to close tax loopholes for corporations, end tax breaks for businesses that move jobs abroad, and stop companies from hiding profits in tax havens.
"At a time of massive wealth and income inequality and soaring corporate profits, it is an outrage that many large, profitable corporations continue to pay little to nothing in federal income taxes," Sanders (I-Vt.) said in a statement. "As working people struggle to pay rent and put food on the table, we have a corrupt and rigged tax code that is designed to benefit the wealthy and the powerful at the expense of working families."
"Meanwhile, Republicans would make a bad situation even worse by providing even more tax breaks to their corporate campaign contributors and the billionaire class while proposing massive cuts to Social Security, Medicare, and Medicaid," he noted, nodding to GOP budget plans for fiscal year 2025, which begins in October.
"That is unacceptable. We need to create an economy and a government that works for all of us, not just the top 1%," Sanders asserted. "And, one of the ways we can begin to do that is by making sure that large corporations pay their fair share of taxes. The Corporate Tax Dodging Prevention Act, unveiled as Americans prepare for the federal income tax deadline on Monday, could raise over $1 trillion in revenue over a decade with the tax haven provision alone, according to the Joint Committee on Taxation.
"Thanks to President Joe Biden, we are growing the economy from the bottom up and the middle out, but we must go even further by passing the Corporate Tax Dodging Prevention Act to help put the interests of everyday Americans ahead of billionaires and transnational corporations," said Schakowsky. "I thank Sen. Sanders for devoting his career to tackling income inequality and am proud to partner with him on this important measure."
Biden's budget blueprint for the next fiscal year, released last month, includes proposals to hike taxes for corporations and ultrarich individuals—whose wealth is soaring to record heights. Such policies are not expected to pass the divided Congress, but they serve as a clear statement of the Democratic president's position just months away from the November election.
When then-President Donald Trump—now the presumptive Republican nominee to face Biden—signed the Tax Cuts and Jobs Act in December 2017, he infamously declared that "corporations are literally going wild over this, I think even beyond my expectations."
Many of that law's cuts are set to expire at the end of next year. During an exclusive Florida fundraiser at the home of a billionaire investor over the weekend, the former president urged his supporters to help him "turn our country around" by taking steps including "extending the Trump tax cuts."

With just over a week left for the U.S. Congress to renew a major—and highly controversial—state surveillance program before it expires, privacy defenders on Tuesday warned that so-called "compromise" legislation is little more than a ploy to permanently reauthorize warrantless government spying on American citizens.
The Biden administration and members of Congress from both parties are seeking to extend Section 702 of the Foreign Intelligence Surveillance Act (FISA), which permits warrantless surveillance of non-U.S. citizens but also captures the communications of Americans.
Following a Tuesday markup session by the House Rules Committee and Wednesday consultations with intelligence officials, House Speaker Mike Johnson (R-La.) is expected to call a vote on the Reforming Intelligence and Securing America Act (RISAA) on Thursday. The bill would reauthorize Section 702 for five years while enacting what supporters call a series of reforms meant to protect Americans against state surveillance.
"Absent significant amendment, RISAA will do nothing to prevent the government's repeated abuses of Section 702 to spy on Americans," said the Brennan Center for Justice, Electronic Privacy Information Center (EPIC), and FreedomWorks in a joint statement.
Introduced in February by Rep. Laurel Lee (R-Fla.), RISAA would reauthorize what the congresswoman called "an indispensable tool that protects us from national security threats within the United States and abroad."
Congress passed a short-term extension of Section 702 last December, with lawmakers unable to agree on whether and how to reform the contentious law that has been abused hundreds of thousands of times, including to spy on protestors, congressional donors, journalists, and others.
RISAA is meant to be a compromise between the Protect Liberty and End Warrantless Surveillance Act and the FISA Reform and Reauthorization Act. The former bill was supported by privacy defenders, while the ACLU warned that the latter "would greatly expand the government's ability to spy on Americans without a warrant."
Proponents are touting RISAA's 56 purported reforms. Johnson asserted last week that the legislation "will establish new procedures to rein in the FBI, increase accountability at the Foreign Intelligence Surveillance Court (FISC), impose penalties for wrongdoing, and institute unprecedented transparency across the FISA process so we no longer have to wait years to uncover potential abuses."
However, civil liberties defenders warn that many of RISAA's so-called reforms are little more than window dressing that preserve the status quo.
"Making 56 ineffective tweaks to a fundamentally broken law is not reforming it," said the Brennan Center, EPIC, and FreedomWorks.
Johnson had previously supported closing the so-called data broker loophole—which the government exploits to purchase sensitive information—and the backdoor search loophole, through which domestic law enforcement agencies can access Americans' communications without a warrant. While the House is expected to vote Thursday on an amendment to close the backdoor search loophole, lawmakers are also likely to vote on three FISA expansions and special protections that only apply to members of Congress.
"This is so disappointing—when Speaker Johnson was on the Judiciary Committee with me, he was in our coalition fighting for major FISA reforms to protect sensitive data. Now that he's speaker, he's folding to spy agencies who want to violate your privacy," Congressional Progressive Caucus Chair Pramila Jayapal (D-Wash.) wrote on social media Tuesday.
Jayapal lamented that RISAA says the "FBI has to notify congressmembers to spy on us, but regular Americans can be spied on without a warrant?"
Demand Progress policy director Sean Vitka said in a statement, "In a truly staggering betrayal of public trust, Speaker Johnson is now not only sabotaging votes on overwhelmingly popular privacy protections for Americans, he is trying to ram through the Intelligence Committee's expansions of FISA."
"This is a five-alarm fire, born from Speaker Johnson's apparent decision to jam his thumb on the scale and sell out everyone in the United States to foreign data brokers," Vitka added.
Furthermore, RISAA contains a provision that Elizabeth Goitein, co-director of the Liberty and National Security program at the Brennan Center, warns "could result in the permanent reauthorization" of Section 702 "without a single reform."
"The House must NOT pass any legislation that could be read to permanently reauthorize Section 702, let alone permanently reauthorizing it without a single reform," Goitein said. "This provision of RISAA must be fixed, or the bill should be DOA."

UN Expert Demands EU Suspend Trade Deal With Israel Over Gaza Genocide

Pointing out a significant "disconnect" between the European Union's political class and the public regarding Israel's assault on Gaza, the top United Nations expert on the occupied Palestinian territories on Wednesday said E.U. officials must suspend trade relations with the Israeli government.
Francesca Albanese, the U.N. special rapporteur on the situation of human rights in the Palestinian territory occupied since 1967, toldEuronews that the E.U. has an "obligation" to suspend its association agreement with Israel because the document bars participants from committing human rights violations like those detailed in Albanese's recent report on the bombardment of Gaza.
Albanese said in her report, titled Anatomy of a Genocide, that she had found "reasonable grounds to believe" Israel's killing of more than 33,000 Palestinians since October—including dozens who have starved to death as a result of a near-total blockade on aid—meets the threshold for a genocide.
With Israel's European allies continuing to trade with the country, Albanese said, the right-wing Israeli government "has no incentive whatsoever to change conduct."
"Israel has the political, financial, economic means to continue operating business as usual," she said. "Europe is the main trading partner—which accounts I think for 30% of Israel's trade—so it has a huge power and it should use that power. In the end, this is not an option, it's an obligation because Article 2 of that association agreement foresees the suspension in case of violations of human rights."
Albanese's demand came nearly two months after Spanish Prime Minister Pedro Sánchez and Irish politician Leo Varadkar, who resigned as prime minister this week, called on European Commission President Ursula von der Leyen to conduct an "urgent review" of whether Israel is complying with its obligations under the association agreement.
Last week, Irish Social Democratic lawmaker Gary Gannon condemned the E.U. for not acting on Sánchez and Varadkar's demand.
"There hasn't actually been an official response from Ursula von der Leyen's office," said Gannon. "You mentioned that it was 'discussed' at the last Council meeting. 'Discussed'? I want more, I want documented minutes of that discussion, I want to know who was in favor and who was against. What could possibly be the justification for not enacting the humanitarian clauses within those agreements?"

Public outcry in E.U. countries over Israel's bombardment of Gaza has intensified as the war has gone on for more than six months, with 44% of French people expressing condemnation of Israel in a poll this month—up from 35% in October.
A group of German civil servants wrote to Chancellor Olaf Scholz this week demanding that Germany—which along with the U.S. provides an estimated 99% of Israel's foreign military aid—"cease arm deliveries to the Israeli government with immediate effect." The civil servants cited the International Court of Justice's interim ruling in January that Israel's assault on Gaza amounts to "plausible acts of genocide."
At The Guardian on Wednesday, E.U. affairs columnist Shada Islam wrote that the bloc's "collective failure to denounce Israel's unrestrained ferocity in Gaza" is "even more egregious" considering the E.U.'s outrage over human rights violations in China, Myanmar, and other countries.
Islam noted that the E.U. adopted a plan in 2020 on human rights and democracy, promising "that respect for human dignity and human rights will underpin all aspects of its policies."
Despite this, she said, "there has been no response to demands from human rights groups for a suspension of the E.U.-Israel trade agreement."
"The E.U.'s inertia makes a mockery of its action plan adopted four years ago," Islam added. "Damage to the E.U.'s reputation risks being irreparable. Even if the slaughter in Gaza is now viewed by many European citizens as an unfolding genocide, that view is not being represented by their governments."
